These Terms of Service ("Terms") govern your use of the Pocket Check mobile application (the "App") operated by Pocket Check LLC ("we," "us," or "our"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. About Pocket Check
Pocket Check is a personal budgeting tool that connects to your bank accounts via Plaid to help you make informed spending decisions. The App provides affordability verdicts, an AI-powered financial coach, budget tracking, and bill management features.
Pocket Check is designed for informational and educational purposes only. Nothing in the App constitutes professional financial, legal, tax, or investment advice.
2. Eligibility
You must be at least 13 years old to use Pocket Check. By using the App you represent that you meet this requirement. If you are under 18, you represent that you have permission from a parent or guardian.
3. Your Account and Responsibilities
You are responsible for:
- Maintaining the security of your device and the App
- All activity that occurs through your use of the App
- Ensuring the accuracy of any information you manually enter into the App
- Complying with all applicable laws and regulations in your use of the App
4. Bank Account Connection
Pocket Check uses Plaid Technologies, Inc. to connect to your financial accounts. By connecting your bank account you agree to Plaid's End User Privacy Policy available at plaid.com/legal/end-user-privacy-policy.
Your bank connection is read-only. Pocket Check cannot initiate transactions, move funds, or modify your accounts in any way. You may disconnect your bank account at any time from within the App.
5. AI Financial Coach
5.1 Informational Purpose Only
The AI financial coach feature provides general information and suggestions based on your financial data. All responses are generated by artificial intelligence and are:
- Not a substitute for advice from a qualified financial advisor
- Not guaranteed to be accurate, complete, or suitable for your situation
- Not professional financial, legal, tax, or investment advice
5.2 No Liability for Financial Decisions
Any financial decisions you make based on information provided by Pocket Check are entirely your own responsibility. We are not liable for any losses, damages, or negative outcomes resulting from actions you take based on the App's verdicts, suggestions, or responses.
5.3 Limitations
The AI coach is designed to answer general budgeting and spending questions. It is not designed to provide advice on investments, gambling, medical expenses, legal matters, or tax planning. Questions in these areas will be redirected appropriately.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, hack, or tamper with the App
- Use the App to transmit malicious code or interfere with our systems
- Misrepresent your identity or financial information
- Use the App in any way that could damage, disable, or impair our services
7. Intellectual Property
All content, design, code, and features of Pocket Check are the property of Pocket Check LLC and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the App without our express written permission.
8. Privacy
Your use of Pocket Check is also governed by our Privacy Policy. By using the App you agree to the collection and use of your information as described in the Privacy Policy.
9. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We do not guarantee the accuracy of financial data retrieved via Plaid or the accuracy of AI-generated responses. Always verify important financial information with your bank or a qualified professional.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, POCKET CHECK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO FINANCIAL LOSSES RESULTING FROM DECISIONS MADE BASED ON APP CONTENT.
Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.
11. Termination
We reserve the right to suspend or terminate your access to the App at any time for any reason, including violation of these Terms. You may stop using the App at any time. Upon termination you may request deletion of your data by contacting us at the email below.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. For significant changes we will notify you through the App. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of California.
